Guidelines on Preventing the Abuse and Misuse of Inclusive Wage Systems to Eliminate Unpaid Labor
Wages are paid as consideration for prescribed working hours; therefore, including overtime work, holiday work, and night work allowances within a fixed monthly wage is unlawful.
To apply the system lawfully, wages must be calculated based on actual working hours. Overtime hours must be specified in the wage ledger and wage statement.
However, the inclusive wage system may be permitted in the following cases:
1. Supervisory or intermittent workers;
2. Employees under an outside work hours system;
3. Employees under a discretionary work hours system;
4. Managerial or supervisory positions.
